Terms of Sale (Consumers)

These Terms and Conditions of Sale (hereinafter "Terms") govern the contractual relationship between Cristian GUTIERREZ VESELKOV and any consumer (hereinafter "the Customer") making a purchase on cgv-digital.com.

Article 1 - Seller Identification

Article 2 - Scope of Application

2.1 Application of Terms

These Terms apply to all sales of digital products or services offered on cgv-digital.com to consumers, i.e., natural persons acting for purposes that are outside their trade, business, craft, or profession.

2.2 Acceptance of Terms

Placing an order implies full and unreserved acceptance of these Terms. The Customer acknowledges having read the Terms before validating their order.

2.3 Modification of Terms

The applicable Terms are those in force on the day of the order. The Seller reserves the right to modify these Terms at any time.

Article 3 - Products and Services

3.1 Description

The products and services offered are digital content and services, including:

• Digital services (web development, digital consulting)
• Digital content (templates, guides, training)

Each product/service has a detailed description outlining its essential characteristics, in accordance with Article L.111-1 of the French Consumer Code.

3.2 Digital Content Characteristics

In accordance with Article L.111-1 of the French Consumer Code, the following information is provided:

• Functionality: The features and functionalities of the digital content are described on the product page
• Compatibility: Technical requirements (operating system, browser, software) are indicated
• Interoperability: Information on compatibility with other systems is specified

Article 4 - Prices

4.1 Prices in Force

Prices are indicated in euros (EUR) and are those in force at the time of order.

VAT: VAT not applicable, Article 293 B of the French General Tax Code.

4.2 Additional Fees

Prices include the provision of digital content. No delivery charges apply for digital content delivered by download or online access.

Article 5 - Order

5.1 Order Process

The order is placed according to the following steps:

1. Product/service selection
2. Add to cart
3. Cart verification
4. Login or account creation
5. Choice of payment method
6. Final order verification
7. Validation and payment
8. Email confirmation

5.2 Order Confirmation

After order validation, the Customer receives a confirmation email including:

• Order summary
• Order number
• These Terms
• Withdrawal form (if applicable)
• Content access information

Article 6 - Payment

6.1 Payment Methods

Payment can be made by:

• Bank transfer (invoice sent via Shine)

6.2 Payment Security

Transactions are secure. We do not store your banking data.

6.3 Payment Date

The order is considered validated upon receipt of full payment.

Article 7 - Digital Content Delivery

7.1 Delivery Methods

Digital content is delivered by:

• Direct download from the customer area, or
• Sending by email to the address provided when ordering, or
• Access to an online platform

7.2 Delivery Time

Delivery is made:

• Immediately after payment confirmation for downloads
• According to the times indicated on the product page for services

7.3 Access Difficulties

In case of difficulty accessing the content, the Customer should contact the Seller at gutierrezveselkovcristian@gmail.com as soon as possible.

Article 8 - Right of Withdrawal

8.1 Principle

In accordance with Articles L.221-18 and following of the French Consumer Code, the Customer has 14 days to exercise their right of withdrawal, without having to justify reasons or pay penalties.

8.2 Exception for Digital Content

IMPORTANT: In accordance with Article L.221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and acknowledgement that they thereby lose their right of withdrawal.

Consequently:

• If you request immediate access to digital content
• And you acknowledge losing your right of withdrawal once access is provided

You expressly waive your right of withdrawal when validating your order.

8.3 Exception for Services

For services, the right of withdrawal cannot be exercised for contracts for the supply of services fully performed before the end of the withdrawal period and whose performance has begun with the consumer's prior express consent and acknowledgement that they thereby lose their right of withdrawal (Article L.221-28, 1° of the French Consumer Code).

8.4 Exercising the Right of Withdrawal

If the right of withdrawal applies, the Customer can exercise it by sending:

• The completed withdrawal form, or
• Any unambiguous statement

8.5 Refund

In case of valid withdrawal, the refund is made within 14 days following the notification of withdrawal, by the same payment method used for the order.

Article 9 - Legal Guarantees

9.1 Legal Guarantee of Conformity

In accordance with Articles L.217-3 and following of the French Consumer Code, the Seller is liable for defects of conformity of the digital content.

Reminder of legal guarantees:

The consumer has a period of two years from the provision of the digital content to obtain compliance in case of a defect of conformity. During this period, the consumer is only required to establish the existence of the defect of conformity and not the date of its appearance.

When the contract provides for continuous provision of digital content for a period exceeding two years, the legal guarantee is applicable to this content throughout the planned provision period.

The legal guarantee of conformity requires the professional to provide all updates necessary to maintain the conformity of the digital content.

9.2 Guarantee Against Hidden Defects

In accordance with Articles 1641 to 1649 of the French Civil Code, the Seller is liable for the guarantee against hidden defects.

Article 10 - Liability

10.1 Seller's Obligations

The Seller undertakes to:

• Provide digital content conforming to its description
• Ensure transaction security
• Respect announced delivery times

10.2 Limits of Liability

The Seller shall not be held liable for:

• Indirect damages
• Non-compliant use of products by the Customer
• Product incompatibility with the Customer's equipment (if prerequisites have been communicated)
• Force majeure events

Article 11 - Mediation

11.1 Prior Complaint

In case of dispute, the Customer first contacts the Seller at gutierrezveselkovcristian@gmail.com to attempt to resolve the dispute amicably.

11.2 Consumer Mediation

In accordance with Articles L.612-1 and following of the French Consumer Code, the Customer may resort to a consumer mediator free of charge.

The Customer may use the European Commission's online dispute resolution platform: https://ec.europa.eu/odr

Article 12 - Intellectual Property

Digital content sold remains the intellectual property of the Seller or its rightholders.

The Customer acquires a personal and non-exclusive right of use. It is prohibited to:

• Reproduce or redistribute the content
• Modify or adapt the content
• Resell or transfer the content to third parties
• Use the content for commercial purposes (without express authorization)

Article 13 - Personal Data

Personal data collected is processed in accordance with our Privacy Policy.

Article 14 - Partial Invalidity

If one or more provisions of these Terms are held to be invalid, the other provisions shall retain their full force and effect.

Article 15 - Applicable Law and Jurisdiction

These Terms are governed by French law.

In case of dispute, and after failure of any attempt at amicable settlement or mediation, the French courts shall have sole jurisdiction.
